The following web site terms and conditions govern your use of this web site, and the various goods and services we provide, which include, without limitation, any social events which we organise and promote on this website, through our social media channels, email, other events, local media and word of mouth (‘events’).

In these Terms and Conditions 'we', 'us', and 'our' refers to Sisca Holdings Pty Ltd (ABN 69 638 915 143) trading as Perth Gay Social Club.

Unless otherwise indicated or implied through the context in which it is presented all intellectual property rights (including copyright and trade marks) in material on this web site belong to us. We grant a revocable licence to the content on this website for the sole purposes of promoting our events in good faith in a manner which is compliant with applicable laws and is not contrary to our good reputation through social media, other media or through other social networks provided that we are made aware of your use of our intellectual property either by written notice or through alerting us (including through ‘tagging us’) through social media either prior to or simultaneous with that use. Otherwise we exclude any implied licences to our intellectual property and you must exercise our exclusive intellectual property rights only with our express written consent.

By purchasing a ticket to or attending one of our events you agree that:

  • You may be photographed for promotional purposes during the course of our events. Such photographs may be reproduced in our social media channels, website and in local media. If you do not wish to be photographed or for photographs containing your image to be made available in any or all channels, please let us know prior to the event so we can accommodate your request.

  • To the extent permitted by law you agree to release us from any liability for loss arising from an act or omission of a third party provider (such as a transport provider, restaurant, bar, movie theatre or other venue) who has provided, facilitated, supervised or organised the provision of any goods or services in connection with an event.

  • To the extent permitted by law, you release us for liability for any indirect, special, consequential or punitive damages.

  • To the extent permitted by law you agree to release us from all liability for losses arising in connection by any goods or services provided by us including our events. If the preceding sentence is deemed to be unenforceable then you agree to limit our liability to the lowest legally enforceable limit being: a) the cost of your ticket, b) AUD$2,000 or c) the amount we are able to recover with respect to such liability from our insurers (unless that amount is $0).

  • To the extent that you are aware of any personal circumstances (including, without limitation, any allergies or medical issues) which might result in you or another person suffering any form of physical, financial, emotional or other harm or increase the risk (other than to a negligible degree) of such harm occurring in connection with an event you plan to attend you agree to give us reasonable prior notice of such circumstances. You understand that, whilst we will take reasonable efforts to mitigate the risks to you associated with your personal circumstance, if we believe your attendance at one of our events might pose a risk to the safety of yourself or others, we may take lawful steps to prevent you from attending that event.

  • If a restraining order, other legally enforceable order or law will or may prevent you from attending one of our events (for instance if you have reason to suspect a person who you are not permitted to be in the vicinity of might attend an event) you must inform us as soon as you become aware of this. If we become aware of any of the circumstances in the preceding sentence you agree that we may refuse to grant or revoke your invitation to attend any such event even if we are only aware of a greater than negligible likelihood of such a breach of a law or legally enforceable order.

  • During and in connection with your attendance at out events you agree to conduct yourself in a manner which is respectful and conducive to the safety of all other participants, service providers and other relevant persons and preserves our good reputation.

  • During and in connection with our events, you agree to comply with all applicable laws (including, without limitation, drug enforcement laws and laws relating to violence and anti-social behaviour) .

  • Some or all of our events may be deemed by us to be suitable for only those over the age of 18 and we may refuse to allow minors to attend such events.

  • You will not use our events for the purposes of marketing any other goods or services without our prior written consent.

  • We warrant that our events will comply with all representations we have expressly made to you with respect that event, otherwise, to the extent permitted by law we exclude all express and implied representations and warranties relating to our events.

  • If we cancel an event or make a material change to the nature, place or time of the event you are entitled to a refund of your purchase price. In all other circumstances you must contact us to request a refund and we will determine whether or not to provide such a refund in our absolute discretion.

 

You agree to indemnify us for all loss suffered in connection with your breach of any of these terms and conditions or any negligent or unlawful act or omission in connection with any of our events.

We make no representations or warranties concerning the security features of this website and to the extent permitted by law we excluded any liability in connection with the use of our web site including any liability for damage or loss to your data or your information technology systems.

These terms and conditions shall be governed by and construed in accordance with the laws which apply in Western Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia.

These terms and conditions constitute the entire agreement between you and us and governs your use of any goods or services provided by us including any events, superseding any other communications and proposals (whether oral, written or electronic) between you and us. These terms and conditions may only be modified by us through changing these terms and conditions as they appear on our website, we will take reasonable efforts to notify you of any changes to these terms and conditions.
